Building an Effective Court Case to Prove Cohabitation

No Legal Time Frame

The first thing to realise is that there isn't a legal time frame for cohabitation. It's worked out on the evidence of each case and the judge decides whether the relationship is cohabitation.

The longer the time frame the more evidence there is for the Judge to consider.

What Will The Judge Consider?

The Judge will consider things such as:

  1. Birth of a child
  2. The sexual relationship between the parties
  3. Whether they live under the same roof
  4. Whether any or both have other accommodation
  5. The extent to which they do things as a couple
  6. The extent to which their finances are linked

None of these by themselves are conclusive.

At the end of the day it will come down to what the Judge believes. So, the more evidence you have the better.

Building a Solid Case

Evidence can be gathered in a number of ways, including:

  • Records of vehicles visiting the premises
  • Surveillance
  • Vehicle tracking
  • Background checks
  • Financial affairs / asset checks
  • Lifestyle profiling
  • Interviews with neighbors

Remember, the more supporting evidence the judge has to consider, the stronger your case will be.
